Governor’s EO Sets Mitigation Metrics for Phase 4 of the Restore Illinois Plan

On January 19, Governor JB Pritzker issued a new Executive Order 2021-03 that officially sets the metrics by which the 11 regions in the state will move between mitigation tiers in Phase 4 of the Restore Illinois Plan.
A summary of the tier restrictions and metrics can be found here, and the Illinois Department of Public Health website reports where each region stands in the mitigation tiers. The EO continues to provide an exemption for governmental functions, and the governor states in the EO that he intends to continue that exemption during this emergency.
Concerning board meetings, the Illinois State Board of Education has stated in its Tier 3 guidance that the restrictions for meetings did not apply to school board meetings. Guidelines from the Illinois Department of Commerce and Economic Opportunity (DCEO) on January 19 similarly states that the mitigation measures, including restrictions on meetings, do not affect services provided by governments to ensure their continued operations or to provide for or support the health, safety, and welfare of the public. However, the DCEO guidance encourages governmental agencies, including school boards, to hold public meetings remotely.
Boards should continue to consult with their counsel and local health departments regarding in-person board meetings held during these various mitigation tiers.
